By, Jack Bloom. The Gauteng Health Department faces medical negligence claims of R513 million and has paid out R40 million to aggrieved claimants since 2006.Legal fees are also high, amounting to R17.5 million since 2006. This is according to written replies to my questions by Gauteng Health MEC Qedani Mahlangu, and information in the latest annual report. According to Mahlangu, “payments were made as a result of settlements out of Court and/or Court Orders” and “claims are paid from the budget of the institutions where actions arose”. The major contributors to claims are Surgery, Obstetrics, Gynaecology and Paediatrics Units. Payments for negligence are an added burden on strained hospital budgets. Much worse is to come if the department has to pay up the half a billion rand tsunami of claims still unsettled. It would be far better if there was no negligence since money cannot bring a loved one back to life or compensate for disability from a botched operation.
